Fort Collins, CO: Man's death from beer bottle stabbing in Fort Collins considered under Make My Day law

A Montrose man whose neck was cut with a beer bottle last weekend in Fort Collins has died from his injuries, and prosecutors are considering whether his death falls under Colorado's Make My Day law.

Shaun Cassidy, 23, died Oct. 9, according to the Larimer County Coroner's Office. He was cut during a fight with his female companion on Oct. 2 after the couple argued while drinking in downtown Fort Collins and then again when they returned to her Fort Collins apartment, police say. Cassidy was hospitalized in critical condition following the incident.

Police called to The Gables at Silverplume complex, 1601 W. Swallow Road, found Cassidy outside the apartment and administered first aid as they waited for paramedics to arrive.

A police spokeswoman referred all questions about the case to the Larimer County District Attorney's Office, which is deciding whether the circumstances of Cassidy's death fall under a Colorado law that permits residents to use deadly force to defend themselves from attack inside
their dwelling.

A spokeswoman for District Attorney Larry Abrahamson could not immediately be reached on Monday morning. Many government offices are closed today for Columbus Day.

Both the coroner's office and the police department confirmed that prosecutors were considering whether the Make My Day law applied in Cassidy's death. An autopsy is set for today.
