The Rockville woman who was killed in Kensington Tuesday morning wrote in court papers this weekend that her children believe her estranged husband was going to kill her.
Montgomery County police on Tuesday said they obtained a warrant charging Philip Joseph Gilberti, 51, with killing his wife, Heather Lynn McGuire, 36, of Rockville. Gilberti, who police say shot McGuire in the head about 9:30 a.m. and left her in the middle of Connecticut Avenue, still was wanted by police Tuesday evening, said police spokesman Capt. Paul Starks.
“He intimidates and harms everyone I talk to. My children believe he is going to kill me if I do anything to upset him,” McGuire wrote in a police affidavit filed Sunday. She received a restraining order against him in November and then filed for divorce from him in December.
Gilberti, was arrested twice during the weekend for violating the court order restricting him from contacting McGuire.
In court papers filed by McGuire early Sunday, she wrote that he called her five times and sent her two text messages that night.
“This has been going on for many years and has been escalating,” she wrote.
