LOUISVILLE, KY (WAVE) - A Portland man is dead after police say he was shot by his wife.
Officers responded to the 2600 block of Rowan Avenue around 11:00 Friday night.
Police say 57-year-old Eugene Henderson and his wife were involved in an argument when Henderson was shot by his wife.
"I left and went to the store. Gone about 15 minutes, come back, police are here. She done shot him," A neighbor who didn't want to be identified told WAVE 3 Saturday.
Henderson was taken to University Hospital where he was pronounced dead from a gunshot wound to the chest.
An LMPD spokeswoman tells WAVE 3 that the wife did have an active domestic violence order against Henderson.
The neighbor told WAVE 3 Henderson had been living with his wife for weeks
"He had been there 3 weeks and no arguments, no nothing," The neighbor said "No police called. No nothing. Then, I mean, she always argued before he came. But, she went and picked him up and brought him over there."
Police are not releasing the wife's name.
An LMPD spokeswoman tells WAVE 3 they are going on the recommendation of the Commonwealth's Attorney's office, who is advising police that they not charge Henderson's wife.
LMPD said the investigation is ongoing.
