BOZEMAN - The attorney for a 59-year-old Bozeman man charged with shooting his wife to death last April says his client plans to change his plea.
Larry Updegraff is charged with deliberate homicide for shooting 47-year-old Roni Updegraff in the head with a shotgun at their mobile home. Defense attorney Eric Brewer says Updegraff will either plead guilty or no contest to the charge during an April 6 change-of-plea hearing.
Court records say a neighbor heard the couple arguing prior to the shooting. A co-worker of Roni Updegraff also told investigators that Roni had complained that her husband was "lazy and wouldn't get a job" and that she was going to "buy him a one-way ticket back to mommy."
Gallatin County Deputy Attorney Todd Whipple has said the state will not seek the death penalty, but if Updegraff is convicted of murder, he could face life in prison.
