KEARNEY - An Overton man who pleaded guilty to beating his girlfriend to death in 2000 is trying to get a new trial.
Timmy Timmens says he didn't have effective representation during his trial and two previous unsuccessful appeals.
The 37-year-old Timmens was sentenced to 45 years to life in prison for the second-degree murder of Tracy Giugler. Prosecutors said Giugler was beaten so severely that all her ribs were broken. Her body was found in the home she shared with Timmens.
Giugler had failed to appear at a family wedding in which Timmens took part. Timmens disappeared after the wedding and was found two days later hiding in an outbuilding in Kearney.
Defense lawyers said no physical evidence showed that Timmens intentionally caused Giugler's death.
