DELRAY BEACH — A 43-year-old man was arrested Wednesday and charged with manslaughter after Delray Beach Police say he murdered his wife by shooting her in the head.
Robert Burton II, of Delray Beach, first told police he was sleeping on the couch March 13 when his wife, 34-year-old Kelly Burton, stood near him and shot a gun, causing him to wake up. Then he said she started walking towards the bedroom and shot herself, according to a Delray Beach police report.
Kelly Leigh Burton's then 10-year-old daughter and the couple's then 2-year-old son were both home.
"Initial information led officers to believe this incident was a suicide," said police spokesman Jeff Messer in a news release on March 15. But the Palm Beach County Medical Examiner ruled the death a homicide.
"It was impossible for the victim to have fired the gun far enough away from her head to kill herself," the report quotes the medical examiner as saying.
