OMAHA (KPTM)- Fox 42 is learning more about a man who police believe is responsible for the third homicide of the year and how he's accused of using his kids to try and cover up the crime.
A judge ordered Antonio McNichols to stay behind bars. He is being held without bond.
McNichols is charged with First Degree Murder and Use and Possession of a Firearm.
He was arrested Friday morning after police found his ex's new boyfriend shot at a home they use to share.
The victim that was shot and killed was 26-year-old Davarus Neelon. His family members were in court Tuesday and were frustrated that their loved one's life was taken from them.
"What I heard, it should be more. It should be life. Like I said he was selfish. He didn't think of our family.
Tears rolled down Leann Robinson's cheeks as she reacted to the charges Antonio McNichols faces.
Police say he shot her cousin Davarus Neelon Friday morning. McNichols faces fifty years in prison if he's convicted. But Robinson says there's no sentence that can make up for the life her family lost.
"It's just not fair because it wasn't gang related. Davarus wasn't gang related. He wasn't a violent person. He was very nice."
New details about the murder that took place Friday emerged in court. Police say after McNichols allegedly shot Neelon, he hid the gun in one of his kid's backpacks.
"Many people are put in jeopardy when something like this happens, including the children," Douglas County Attorney Don Klein said.
According to court records McNichol's ex-girlfriend tried to protect their children. She claimed she received threatening text messages and was assaulted by McNichols.
She filed a request for a protection order in September that was denied. Klein didn't have any comments as to why this happened, but that as details come to light the case is unnerving.
"There are many very disturbing elements to this as there are many crimes, but particularly this kind of case. "
Now Robinson is forced to play the guessing game. Asking herself if the protection order was granted if she would still have her cousin. "It's a terrible, terrible thing. Real horrible."
McNichols will appear in court for a preliminary hearing February 15th.
