Man arrested in girlfriend's death


LEE COUNTY: A Fort Myers man was arrested for the January death of his girlfriend.

Lee County deputies say on January 31, they took a call and went to 5141 Tice Street in Fort Myers in reference to a death investigation. When they got there, they found the body of 28-year-old Cindy Warner.

Javier Torres, 37, was also at the home when deputies arrived. He told them he was Warner's boyfriend.

He told deputies that his girlfriend was complaining about a headache the night before and took some powder cocaine and Oxycontin before falling asleep. He went on to say that when he woke up, he saw that she wasn't breathing.

He said he tried to perform CPR, but it wasn't working so he called 9-1-1. But by the time emergency responders arrived, she was already dead. Her body was then given to the medical examiner to find out an exact cause of death.

Deputies say their initial findings suggested Warner died because of an apparent drug overdose. But, they say, the results of the autopsy told a different story.

The medical examiner said Warner was strangled.

An investigation revealed that Torres was the only person with Warner when she died. So once a warrant was approved for his arrest, he was arrested without any problems.

Torres was charged with Manslaughter - a second degree felony.
