Seal Beach, CA: Elderly SoCal man charged in wife's death

SEAL BEACH, Calif., Nov. 23 (UPI) -- California prosecutors said they charged an 88-year-old man with first-degree murder for allegedly shooting his ailing wife to death at a nursing home.

The charges announced Tuesday against Roy Laird of Seal Beach included a sentencing enhancement for using a firearm in the Sunday slaying of his 86-year-old wife, Clara.

The Orange County District Attorney's office said in a written statement that Laird faced life in prison and that state law required a mandatory $1 million bail.

Clara Laird, who suffered from late-stage dementia and required round-the-clock care, was shot to death in her bed. Her husband of 69 years was arrested without incident by Seal Beach police, who responded to a 911 call placed by staff members.

Oro Valley, AZ: OV man gets 22 years for strangling mother of their daughter, 2

An Oro Valley man who strangled the mother of his young daughter in August 2008 was sentenced to 22 years in prison Tuesday.

Paul Beam, 37, pleaded guilty last month to second-degree murder in the death of Lisa Berrie.

Beam was originally sentenced to life for killing Berrie, but his first-degree murder conviction was thrown out because of juror misconduct.

He elected to enter a deal with prosecutors two weeks before his new trial was to begin.

Beam called his father at about 9 p.m. Aug. 12, 2008, and asked him to come to his apartment, in the 8800 block of North Oracle Road. When Beam's father arrived, he found Berrie, 25, unresponsive and bloodied on the floor of the master bathroom. An autopsy revealed Berrie had been strangled.

Defense attorney Darlene Edminson-O'Brien told jurors that Beam acted in the heat of passion after Berrie told him she was leaving him and taking their 2-year-old daughter.

Prosecutors Nicol Green and Jesse Delaney argued that Beam had time to reflect on his actions while strangling Berrie - thus making him guilty of first-degree murder.

It was later learned that a juror failed to tell the court she herself had been a domestic-violence suspect and victim.

Beam must serve every day of his sentence.

Lexington, KY: Trial begins in case of man accused of killing girlfrien

d
By Jennifer Hewlett - jhewlett@herald-leader.com
Had April Brooks not taken a baseball bat into Edward Stokley's home, things might have turned out differently at 538 Bishop Drive on April 29, 2009, defense attorney Tom Griffiths suggested to a jury Monday.
Stokley, then 34, shot his girlfriend, Lavena Gibson, 25, four times — twice in the chest and twice in the left leg — while she was outside the house with Brooks, Brooks' sister and an 8-month-old baby, prosecutor Cindy Rieker said.
Gibson died on the operating table that day at University of Kentucky Chandler Hospital.

Stokley, who does not deny shooting Gibson, is on trial this week for murder. He also is charged with three counts of wanton endangerment, and being a convicted felon in possession of a handgun and a persistent felony offender.
"At the end of this case, you're going to find him guilty of something. He knows that," Griffiths told the Fayette Circuit Court jury during opening arguments Monday.
Gibson and Stokley had had an on-again, off-again relationship for years. Before the shooting, the two had been living with Stokley's mother, Barbara Stokley, at the Bishop Drive house. The couple had been arguing in the days just before the shooting. Gibson left, telling the Stokleys she was going to a grocery store, attorneys involved in the case said.
She didn't return.
In the meantime, Edward Stokley called Gibson's mother in Colorado, telling her, "I am going to kill your baby for leaving me," Rieker told the jury.
On the day she was shot, Gibson went to the Bishop Drive house to get her belongings. She drove there with her friends, sisters Angela and April Brooks, along with Angela's infant daughter. Gibson went inside; Stokley, who had been on the back patio, went to the car and began ripping out the radio in the vehicle. He went inside the house after his mother came to the door and told him to stop.
Neighbors and Gibson's friends in the car heard arguing inside the home. April Brooks, armed with a bat, went inside to protect her friend. Stokley was in the kitchen, beating Gibson.
Stokley pointed a gun at Brooks, and she ran back to car. Gibson, who got away from Stokley while his mother held on to him, also ran to the car, where her friends were waiting.
Stokley broke free from his mother, ripping the shirt from his back, then went outside and began shooting into the car, Rieker said.
At some point, Gibson got out of the car, and Stokley continued shooting, Rieker said.
Griffiths said Stokley had had no particular plans on April 29, 2009, other than to be with his mother, and possibly his sister, and to visit friends on the east end of town.
He always carried a gun when he went to the east end, a rougher neighborhood than the area where he lived, Griffiths said. Stokley did not take the gun out of his pocket when he got back home, the lawyer said.
After Gibson drove up, Stokley took the radio from the car, which he and Gibson had shared, because the radio was his, the attorney said.
Griffiths, who said that Stokley and Gibson had put their hands on each other during fights in the past, described what went on in the kitchen as fighting. Stokley took his gun out of his pocket after he saw someone over his shoulder holding up a bat, Griffiths said.
Stokley complained of chest pains after he fled the scene and was tracked down by police, the attorneys in the case said.
Stokley sobbed when he heard that Gibson had died and that he would be charged with murder, Griffiths said.

A Pacific Grove woman was found dead Sunday, and her daughter's estranged boyfriend has been arrested on suspicion of murder, police said.
Judith Salazar, 46, was stabbed to death in her home, where she was found on the floor. Next to her, suffering from knife wounds, was the suspect, Sunny Nguyen, 26, of Seaside, Pacific Grove police said.

Nguyen, who is recovering at a San Jose hospital, is believed to have attacked Salazar after taking a taxi from Seaside to the house. The taxi driver was asked to wait outside, but called police after suspecting Nguyen would not return to pay the fare, Chief Darius Engles said Monday.

The driver had been waiting for "an extended period of time," he said.

Officers arrived and knocked on the front door. There was no answer, but they could see movement inside and hear noise, police said.

At least one officer looked in the window and saw what appeared to be blood splattered on a wall. Officers then broke in.

Salazar was pronounced dead at the scene, and Nguyen was taken to the hospital.

Investigators are trying to determine if his wounds were self-inflicted or caused by Salazar trying to defend herself, Engles said.

"We'll be doing a forensic exam," he said.

Salazar's daughter, whom police have not identified, has two children with Nguyen.

Police have not discussed a motive for the killing, but the couple has been estranged for some time. The children were living with their mother and Salazar in

The children, an 8-month-old boy and 2-year-old girl, were in the home when their grandmother was killed. They were in another room and weren't harmed, Engles said. The mother of the children was out with friends for the evening.

The children were initially placed in protective custody, but they were later reunited with their mother, Engles said.

Salazar was a special education teacher at Alisal High School in Salinas.

Principal Dan Burns said Salazar worked at the school for about five years. A staff meeting was held to discuss the news, and counselors will be available today.

"It's tragic," he said.

Nguyen will be booked at Monterey County Jail on suspicion of murder once he is released from the hospital, police said.

Raleigh, NC: Man guilty of killing woman at day care

BY ANNE BLYTHE - STAFF WRITER
RALEIGH -- A man who shot himself in the chest 13 months ago after gunning down his estranged girlfriend in a church day care center lot pleaded guilty Monday to second-degree murder.

Daniel Jerome Montgomery, 32, admitted in Wake County Superior Court to killing Jammie Shantal Street, a school bus driver from Fuquay-Varina with whom he had a rocky relationship. The deadly incident occurred Oct. 7, 2009, outside the St. Augusta Missionary Baptist Church inFuquay-Varina.

Street, who had a child with Montgomery, had just dropped off her two oldest children at the church day care center and was planning to take her youngest child to another center. But Montgomery showed up, according to prosecutors, and attacked and shot Street before turning the gun on himself.

Montgomery was sentenced to a maximum of 241/2 years in prison.

The stormy relationship between Montgomery and Street first came to the attention of police in February 2009, when Montgomery was charged with domestic trespassing after entering Street's home without her permission. He was released from jail on $3,000 bail the same day, court records show.

The trouble between them - and their relationship - continued through March.

About 6:15 a.m. on Oct. 7, 2009, witnesses said, Street's two older children ran into the day care at St. Augusta Missionary Baptist Church shouting that Montgomery was outside beating their mother. When a worker went out, she found the youngest child roaming the sidewalk. Soon after, she heard gunfire and ushered the boy inside.

Police found Street's body in the road and Montgomery in the bushes across the street.

Painesville Township, OH: Todd O’Brien headed to trial Monday, accused of killing ex-girlfriend

Published: Tuesday, November 23, 2010

Jury selection is expected to begin Monday in the case of an Eastlake man accused of murdering his ex-girlfriend by purposely running her over.

Todd O’Brien, 25, is accused of backing over 23-year-old Kayelee Russell-Martin with his Chevrolet Malibu June 15 in Painesville Township.

O’Brien will stand trial on 13 counts — aggravated murder, failure to stop after a crash, aggravated vehicular homicide, two counts of murder, three counts of violating a temporary protection order and five counts of felonious assault.

His attorneys are expected to argue O’Brien accidentally ran over Martin after a man at the scene pepper-sprayed the defendant while he was driving.

Prosecutors are expected to call up to six expert witnesses — including a Lake County Crime Lab employee who would testify that the pepper spray was deployed only on the outside of O’Brien’s vehicle, Assistant Lake County Prosecutor Mark Bartolotta said Monday during a final pretrial hearing in Lake County Common Pleas Court.

Judge Eugene A. Lucci expressed surprise when Aaron Baker, one of O’Brien’s four attorneys, said he does not have an expert witness to dispute the state’s pepper spray evidence.

“I find it interesting that if that’s a big issue in the case, you didn’t retain your own expert,” Lucci told Baker.

Normally, Lucci calls 50 people for jury selection. In this case, he said letters went out to about 125 potential jurors because of an abnormal amount of pretrial publicity.

Twelve people will be chosen for the jury, plus four alternates.

Lucci said he already has excused about 25 potential jurors on his own.

“We’ve lost a number of jurors for their vacations,” said the judge. “You’ve got a couple teachers in there who said that (serving on a jury) would be an unreasonable request at the end of the grading period.”

Others were excused because of surgery and other medical issues. One woman was dismissed because her daughter was kidnapped and murdered and she did not want to be in a courtroom.

Lucci refused to mail out a lengthy questionnaire that was prepared by O’Brien’s attorneys for the 100 remaining potential jurors.

“I estimated it would take each juror between four and eight hours to complete the questionnaire,” the judge said. “Twenty or 30 pages asking for narrative answers on almost every page — including all the books they’ve read, all the movies and TV programs they watch — that type of questionnaire would be reasonably calculated to scare every juror out of their wits.”

Instead, Lucci will have the jury pool fill out a short questionnaire he approved himself.

Because of fire code restrictions in the court room, the potential jurors will be put under oath and then fill out their forms in an assembly room at the nearby Lake County Administration Building.

Neither the defense nor prosecutor objected to Lucci’s questionnaire, which will ask basic questions such as whether anyone has heard of the defendant through media reports or discussed the case — even online. Other questions include whether they know any potential witnesses listed.

Lucci has allowed O’Brien — who remains in Lake County Jail on a $1 million bond — to wear street clothes when he goes to trial.

Opening arguments are not likely to begin until the jury is bused to the Cambridge Condominiums complex, where Martin was struck.

Martin lived at the complex with her and O’Brien’s 4-year-old son, Alex.

Martin, her son and her boyfriend went for a walk in the complex the day she was killed.

Earlier in the day, Martin called 911, claiming O’Brien drove by and tried to hit them.

Martin sent her son to stay with a neighbor the day she died.

Martin had previously accused O’Brien of stalking her, and he was not allowed within 500 feet of her.

The jury view is expected to happen as early as Nov. 30.

O’Brien’s attorneys said the trial could last up to three weeks.

Virginia Beach, VA: Man charged with killing girlfriend in a Virginia Beach motel room

5:35 PM EST, November 22, 2010

In Virginia Beach a man is charged with killing his girlfriend in a motel room.

Police say the suspect, James Woods, called and reported the shooting to police.

Red evidence tape marks the room at the Red Carpet Inn where the shooting took place.

Police arrived at the motel, located on Diamond Springs Road, shortly after midnight after getting a call about the shooting.

It was there that they found 48-year-old Barbara Ann Nave with a gunshot wound - she was pronounced dead on the scene.

Police say her boyfriend, 50-year-old James Ralph Woods, was the one who shot and killed her.

He was also the one who called 911.

Police arrested him at the scene.

NewsChannel 3 spoke with Woods' father off-camera. He says the couple had dated about a year, then Woods moved into the motel with his girlfriend about two months ago.

He also says that Woods had a drinking problem that has gotten him in trouble with the law before.

He says he was just in jail recently for a DWI.

Now he is back in jail, held without bond on charges of murder and use of a firearm in the commission of a felony.

"That's terrible really, that's really bad, really bad," said Carlton Smith, who lives at the motel.

Smith has lived at the motel for about ten months. He says he had seen Woods a few times and news of the shooting comes as a shock.

"It's surprising me, because we don't hear about like that around here, you know, shootings like that, no."

Woods declined the request for an interview.

Las Vegas, NV: Bail set at $1 million for man accused of killing teacher wife

Man accused of murder weeps as prosecutor describes wife's slaying

By FRANCIS MCCABE
LAS VEGAS REVIEW-JOURNAL

Mark Franta, charged in the death of his wife, Marybeth, and Deputy Public Defender Christy Craig appear during a hearing Monday . Prosecutor Christopher Lalli told the justice of the peace that when Las Vegas police confronted Franta, he gave them “a story of all-out lies.”
GARY THOMPSON/LAS VEGAS REVIEW-JOURNAL

Mark Franta, wearing shackles on his legs and arms and wrinkled navy blue prison scrubs, wept Monday in Las Vegas Justice Court as a Clark County prosecutor detailed his wife's slaying.

Prosecutor Christopher Lalli, who was arguing that bail be set at $1 million, described how the 50-year-old defendant was caught on surveillance video dumping Marybeth Franta's body behind the Albertsons at Craig Road and Tenaya Way, in the northwest valley.

Lalli told Justice of the Peace Eric Goodman that when Las Vegas police confronted Mark Franta, he gave them "a story of all-out lies."

Marybeth Franta, a popular science teacher at Molasky Junior High School, died a slow death, Lalli said. Her body was "badly beaten" and her life snuffed out by strangulation, the prosecutor said.

Crying echoed throughout the courtroom filled with family members of both the defendant and the victim.

Goodman set bail at $1 million for Mark Franta, who is charged with one count of murder. He remains in custody at the Clark County Detention Center, according to jail records.

Deputy Public Defender Christy Craig had asked Goodman to set bail at $25,000, arguing that her client has family ties to the community and has every incentive to stay and see the case through.

"A million dollars might as well be no bail at all," Craig said, to no avail.

The couple's two children, both in their 20s, sat in the courtroom with Mark Franta's siblings. They were separated by several rows from members of Marybeth Franta's family, including several of her siblings.

After the hearing, Marybeth Franta's younger brother, Marine Col. Stephen Nitzschke, said his family appreciates the outpouring of support and sympathy from members of the Las Vegas community.

Her family is "hoping for justice," Nitzschke said, but it has been very difficult because they considered Mark Franta a member of the family. The colonel said it has been hardest on the two children.

"They lost two parents in this tragedy," Nitzschke said.

Nitzschke described his sister, older by one year, as kind, caring and considerate, and a positive influence on Las Vegas for more than 30 years. He described the couple as normal and could not speak to any prior incidents of domestic violence.

Mark Franta's family and the couple's children declined to comment after the hearing.

Craig said Mark Franta was despondent. She said he is concerned mostly about the two children and what this is doing to them.

Investigators said they think Marybeth Franta returned home the evening of Nov. 13 after attending a wedding and argued with her husband, who had been drinking. They allege Mark Franta then killed his wife.

Las Vegas police say video footage from two businesses shows Mark Franta early Nov. 14 near where his wife's body was found. Later that day, Mark Franta reported his wife missing. He was arrested Nov. 17.

There had been no documentation of domestic violence in the couple's marriage of more than 20 years. But family friends have said there was friction recently because Mark Franta, an ironworker, had lost his job.

News of Marybeth Franta's death has shocked many in Las Vegas, including students and colleagues at Molasky Junior High and members of the local equestrian community. She was a former director of the Nevada State Horsemen's Association.

LINCOLNTON, Ga. --- Lincoln County authorities are investigating the deaths of a man and woman found in a home Monday morning.
The bodies of Chris Holloway, 53, and his wife, Pamela LeRoy Holloway, 37, were discovered by Lincoln County Sheriff's Office personnel at their home shortly after 8 a.m.
Family members notified authorities after hearing shots fired from the home at 1973 Indian Road in Lincolnton, according to Mike Ayers, special agent in charge of the regional Georgia Bureau of Investigation's office in Thomson.
Authorities said the incident is the result of a domestic dispute that turned ugly when Chris Holloway shot his wife to death before turning the gun on himself.
It was not known whether Chris Holloway had any history of domestic violence.
"This is unusual for us," Sheriff Gerald Lawson said of the deaths. "But I want my community to know that they should feel safe. This is still a safe community to live in."
The bodies have been sent to the GBI's lab in Augusta for autopsy.
The homicide was the first in Lincoln County in more than five years. The last one occurred in February 2005.

Fort Valley, GA: Sheriff says couple in murder-suicide was divorcing

By BECKY PURSER - bpurser@macon.com

FORT VALLEY -- A Fort Valley couple was in the middle of a divorce when the husband murdered his wife and killed himself, the Peach County sheriff said.
James Wallace, 54, shot his wife, Annie Ruth Wallace, 54, twice in the neck and once in the head Friday as she sat in front of her computer at their home at 206 Summer Breeze Drive, Peach County Sheriff Terry Deese said Monday.

Before turning the 9mm pistol on himself, Wallace went to the bedroom where his adult daughter, Charidy Wallace, was lying in bed and he told her to leave the home, Deese said.
The daughter told authorities that her father told her that “she needed to leave. He couldn’t take it anymore,” Deese said. Wallace had the pistol in his hand.
The daughter told authorities she was sleeping when she heard what she now realizes were gunshots but initially dismissed it as possibly her mother dropping something, Deese said. But when the father came to the door and she saw the pistol in his hand, she realized what had happened.
She left the home immediately, went to a neighbor’s home and 911 was called at 1:25 p.m.
Arriving deputies found both the wife and the husband shot dead inside the home, with the gun still in James Wallace’s hand where he shot himself in the living room.
No suicide note was found, but Wallace did leave a note for the daughter who lived in the home about financial matters. The sheriff believed that the couple had other adult children who do not live at the home.
Deese said the case is straightforward, with no doubt that the incident was a murder-suicide.
Monday’s autopsy for Annie Ruth Wallace was a formality before her body was released to family in part to confirm that the bullets matched the gun used, Deese said. An autopsy is not planned for James Wallace.
The autopsy found that Annie Ruth Wallace died from her injuries from the bullet wounds, Peach County Coroner Kerry Rooks said.
“There’s no doubt about it. There’s no doubt that was the gun that he (James Wallace) used to shoot her with,” Rooks said.
Family members were gathered Monday at the one-story brick home, which is located in the Country Meadows subdivision off of Housers Mill Road in Peach County. Mark Davis, the brother of Annie Ruth Wallace, said the family was not ready to talk at this time.
The murder-suicide marks the first homicide in unincorporated Peach County in 2010.
